Article 2 — Applicability
These terms and conditions apply to every offer from Gallery 024 and to every distance contract concluded between Gallery 024 and the consumer. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated how the terms and conditions can be viewed at Gallery 024 and that they will be sent free of charge as soon as possible at the consumer's request.
Deviating clauses are only valid if they have been explicitly accepted in writing by Gallery 024.
Article 3 — The Offer
If an offer has a limited validity period or is made subject to conditions, this will be explicitly stated in the offer. The offer contains a complete and accurate description of the artworks offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. Images are a true representation of the artworks offered. Minor color deviations from the original may occur due to differences in screen display and are not grounds for complaint.
Obvious mistakes or errors in the offer do not bind Gallery 024.
Article 4 — Prices
All stated prices are in euros, include VAT, and exclude shipping costs, unless otherwise stated. Shipping costs will be made visible during the ordering process before the agreement is concluded.
During the validity period stated in the offer, prices will not be increased, except for price changes resulting from changes in VAT rates.
Article 5 — The Agreement
The agreement is concluded at the moment the consumer accepts the offer and fulfills the conditions set forth therein. Gallery 024 will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the consumer can dissolve the agreement.
Article 6 — Payment
Unless otherwise stipulated in the agreement or additional conditions, the amounts owed by the consumer must be paid within 14 days after the conclusion of the agreement. Payment can be made via the payment methods offered in the webshop (including iDEAL, credit card, bank transfer).
The consumer has the duty to immediately report inaccuracies in provided or stated payment details to Gallery 024.
Article 7 — Delivery and Shipment
Gallery 024 will exercise the greatest possible care when executing orders. The delivery address is the address that the consumer has made known to Gallery 024.
Orders will be executed as quickly as possible, but no later than within 30 days after receipt of payment, unless a different delivery time has been agreed upon. In the event of exceeding the delivery period, the consumer will be notified as soon as possible and has the right to dissolve the agreement free of charge.
The risk of damage and/or loss of products rests with Gallery 024 until the moment of delivery to the consumer, unless explicitly agreed otherwise. For larger or fragile artworks, courier transport or personal delivery can be arranged upon request.
Article 8 — Right of Withdrawal
The consumer has the right to dissolve the agreement without stating reasons for 14 days after receipt of the product. This reflection period starts on the day after the consumer, or a third party designated by him in advance, has received the product.
During the reflection period, the consumer will handle the product and its packaging with care. The consumer will only unpack or use the product to the extent necessary to assess the nature, characteristics, and functioning of the product. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a physical store.
The consumer is only liable for depreciation of the product that is the result of a way of handling the product that goes beyond what is permitted.
Article 9 — Exercise of Right of Withdrawal and Costs
If the consumer makes use of his right of withdrawal, he reports this within the reflection period by means of an unambiguous statement via e-mail to info@gallery024.com, or via the model withdrawal form.
The consumer returns the product to Gallery 024 within 14 days after this notification. The direct costs of returning the product are for the account of the consumer, unless otherwise agreed.
Gallery 024 will refund the full purchase amount, including any delivery costs, within 14 days after withdrawal, provided the product has been received back or the consumer has demonstrated that the product has been returned.
Article 10 — Exclusion of Right of Withdrawal
The right of withdrawal is excluded for products that are custom-made or clearly personal in nature, including artworks that have been manufactured or adapted at the consumer's request. This will be clearly stated in the offer of the product concerned.
Article 11 — Conformity and Warranty
Gallery 024 guarantees that the delivered artworks comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the statutory provisions existing on the date of the conclusion of the agreement.
The consumer's legal rights remain fully applicable. Any defects or incorrectly delivered products must be reported to Gallery 024 in writing within a reasonable period after discovery.
Article 12 — Complaints Procedure
Complaints about the execution of the agreement must be submitted to Gallery 024 via info@gallery024.com, fully and clearly described, within a reasonable time after the consumer has discovered the defects.
Complaints submitted to Gallery 024 will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, Gallery 024 will respond within the 14-day period with an acknowledgment of receipt and an indication of when the consumer can expect a more extensive answer.
The consumer can also submit a complaint to the Disputes Committee via the European ODR platform: https://ec.europa.eu/odr.
Article 13 — Applicable Law and Disputes
Agreements between Gallery 024 and the consumer to which these terms and conditions relate are exclusively governed by Dutch law. This also applies if the consumer resides abroad.
The Vienna Sales Convention is not applicable. Disputes arising from or related to this agreement will be exclusively submitted to the competent court in the Gelderland district, unless mandatory law dictates otherwise.
Article 14 — Additional or Deviating Provisions
Additional provisions or provisions deviating from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.
